TheHexaTown Terms of Use

Last updated:

These Terms of Use govern your use of thehexatown.com, run by TheHexaTown LLC, a Delaware limited liability company, and its affiliate TheHexaTown Private Limited (Pakistan). You may read, share and quote our content with attribution, and search engines and AI crawlers that honor robots.txt may crawl, index, cite and train on it.

Who we are

In these Terms, "TheHexaTown," "we," "us" and "our" mean TheHexaTown LLC, a Delaware limited liability company with its registered address at 8 The Green, STE R, Dover, DE 19901, USA, and its affiliate TheHexaTown Private Limited, a company registered in Pakistan. "You" means anyone who visits thehexatown.com or contacts us through it.

Accepting these terms

By using thehexatown.com you agree to these Terms. If you do not agree, please do not use the website. You must be at least 18 years old, or the age of majority where you live. If you use the website on behalf of a company or other organization, you confirm that you can accept these Terms for it.

Our Privacy Policy and Cookie Policy explain how we handle personal data and cookies. They form part of these Terms.

Our services and client agreements

TheHexaTown designs and builds custom software, web and mobile apps, and cloud and AI solutions. The website describes that work; it is not an offer. Every client engagement is governed by a separate written agreement, such as a master services agreement and a statement of work ("SOW"), which sets out the scope, deliverables, timeline, fees and payment terms. If a signed agreement conflicts with these Terms, the signed agreement prevails.

We may:

  • Change, update or discontinue any service offering, with reasonable notice where possible.
  • Decline a project or an engagement, subject to our obligations under any active SOW.
  • Use qualified subcontractors or partners for parts of a service, while staying responsible for the overall delivery.

Client accounts

If we give you access to a client portal or project account, you are responsible for:

  • Account security: keeping your login details confidential and not sharing access with unauthorized people.
  • Account activity: all activity under your account.
  • Accurate information: giving us truthful, up-to-date information.

If you suspect unauthorized access to your account, tell us right away at contact@thehexatown.com.

Acceptable use

You may use the website, and any software or systems we deliver, only for lawful purposes and in line with these Terms. You must not:

  • Use the website or anything we deliver for illegal, harmful or fraudulent activity.
  • Reverse engineer, decompile or tamper with software or systems we deliver, except as your agreement with us allows or as the law permits.
  • Resell, sublicense or redistribute delivered work or our proprietary tools without our written permission.
  • Try to gain unauthorized access to our systems, our infrastructure or other clients' data, or probe, scan or test their vulnerability without our written permission.
  • Disrupt or overload the website, for example with automated requests that ignore our robots.txt file or send traffic faster than the site can reasonably serve.
  • Submit false information, spam or malicious code through our forms.

We may block access, suspend services and report violations to the relevant authorities where the law requires it.

Does TheHexaTown allow AI crawlers to use its content?

Yes. Search engines, answer engines and AI crawlers may crawl and index the public pages of thehexatown.com, cite and link to them in search results and AI answers, and use their content to train machine learning and AI models, as long as the crawler:

  • follows the rules in our robots.txt file;
  • identifies itself with an honest user agent; and
  • does not overload or disrupt the website.

Our robots.txt file currently allows all crawlers, including AI training crawlers, on every public page. We may change it, and the version published at the time of crawling applies. This permission covers public pages only. It does not cover our forms or APIs, any area that needs a login, or the use of our name and logos to suggest that we endorse a product, service or answer.

Can I quote or reuse content from thehexatown.com?

Yes, within limits. You may read, download and print pages for your own personal or internal business use, share links to any page, and quote short excerpts if you credit TheHexaTown and link to the page you quote.

You may not republish substantial parts of the website, sell or license our content, remove copyright notices, or present our content in a way that suggests we endorse you. For any other use, ask us first at contact@thehexatown.com.

Intellectual property

The website and its content, including text, images, graphics, videos and logos, belong to TheHexaTown or its licensors and are protected by copyright and other laws. Ownership of work we produce for clients is set by the signed agreement for that work. Unless that agreement says otherwise:

  • Client ownership: once you have paid in full, you own the final deliverables specified in your SOW, including the custom software and its documentation.
  • Our tools: we keep ownership of our pre-existing tools, frameworks, methods, templates and code. Where they are part of your deliverable, you receive a non-exclusive, perpetual license to use them as part of the delivered product.

Trademarks

"TheHexaTown" and our logos are trademarks of TheHexaTown. You may not use them without our written permission, except to refer to us accurately. Other product and company names on the website may be trademarks of their owners; mentioning them does not imply any affiliation or endorsement.

Payments and billing

Fees and payment terms for client work are set in your SOW or service agreement. Unless it says otherwise:

  • Invoicing: we invoice on the schedule in your agreement, for example by milestone, monthly or on completion.
  • Payment methods: payments go through our supported payment providers. We do not store full card details on our servers.
  • Late payments: overdue payments may pause or suspend active services until the balance is settled.
  • Disputes: raise any billing dispute in writing within 14 days of the invoice date. After that, the invoice is treated as accepted.
  • Refunds: because these are professional services, we review refund requests case by case. Contact us at contact@thehexatown.com.

Confidentiality

Both parties keep confidential any proprietary or sensitive information shared during an engagement, including business plans, technical specifications, client data and commercial terms. This duty continues after the engagement ends. Where a separate non-disclosure agreement ("NDA") is in place, its terms prevail.

Electronic communications

When you contact us or become a client, you agree that we may send you electronic messages about your inquiry or project, such as replies, project updates, invoices and service notices. Marketing emails are sent only with your consent where the law requires it, and every one has an unsubscribe link.

Third-party services and links

The website uses third-party services, such as analytics, scheduling and form tools, described in our Privacy Policy. Our work may also involve or recommend third-party platforms, such as cloud providers. We are not responsible for their availability, performance or data practices. Links to other websites are for convenience and do not mean we endorse them; please read their terms and privacy policies.

Disclaimers

The website and its content are provided "as is" and "as available," without warranties of any kind, to the extent the law allows. Warranties for client work, if any, are set out in the signed agreement for that work. We do not warrant that:

  • delivered software will be free of every bug or run without interruption in every environment;
  • information on the website is always complete, accurate or current; or
  • our services will achieve business outcomes beyond those defined in your SOW.

Limitation of liability

To the fullest extent the law allows, TheHexaTown is not liable for any indirect, incidental, special or consequential damages arising from your use of the website or our services, including lost profits, business interruption, loss of data or production system failures, even if we were told such damages were possible.

Unless your signed agreement says otherwise, our total liability for any claim arising from an engagement will not exceed the fees you paid us for that engagement in the 3 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

Termination

Either party may end an engagement as set out in the relevant SOW or service agreement. We may suspend or end your access to the website or our services right away if you breach these Terms or act in a way that harms our business or other clients.

When an engagement ends, outstanding invoices become due, and you must stop using any proprietary tools or licenses provided only for that engagement. The sections on intellectual property, confidentiality, disclaimers and limitation of liability survive termination.

Which law governs these terms?

These Terms, and any dispute arising from them or from your use of the website, are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. We will first try to resolve any dispute informally, so please contact us at contact@thehexatown.com before taking formal action.

If we cannot resolve it, the state and federal courts located in Delaware have exclusive jurisdiction, and you and we agree to their jurisdiction. This does not take away any rights you have under the mandatory consumer protection laws of the country where you live. A signed client agreement may choose a different law or forum for the services it covers; if it does, that choice applies.

Changes to these terms

We may update these Terms from time to time. When we do, we change the "Last updated" date at the top of this page. If you keep using the website after an update, the updated Terms apply to that use.
